The Prevagen Lawsuit: What Happened and Why It Matters

Quick answer

The Prevagen lawsuit is a federal case the FTC and the New York Attorney General brought against Prevagen's maker in 2017 over its memory claims. In March 2024 a jury found none of eight challenged claims supported, and in December 2024 a judge barred them. The same test applies to any memory supplement ad.

What is the Prevagen lawsuit?

The Prevagen lawsuit is a federal case, FTC and People of the State of New York v. Quincy Bioscience Holding Co., filed in January 2017 (FTC & NY AG v. Quincy Bioscience (Prevagen)).

The agencies challenged the memory claims made for Prevagen. The FTC said the maker's own Madison Memory Study (218 subjects) showed no significant benefit over placebo on any of nine cognitive tasks.

What did the jury and judge decide?

The jury found that none of eight challenged memory and cognition claims had competent and reliable scientific evidence behind it (FTC & NY AG v. Quincy Bioscience (Prevagen)).

It called two of them materially misleading: "reduces memory problems associated with aging" and its "clinically shown" version. On December 6, 2024, Judge Louis L. Stanton barred all eight statements but denied penalties and disgorgement. The maker appealed, and our source says that appeal was still pending in February 2026.

What does the Prevagen lawsuit teach about memory supplement ads?

It teaches that a memory claim needs trial evidence, not a testimonial or a disclaimer.

FTC guidance says testimonials do not substantiate health claims, and the standard disclaimer does not rescue a misleading one (FTC, Health Products Compliance Guidance). The FDA also warned 17 companies in 2019 over Alzheimer's claims (FDA, Alzheimer's claims warning letters 2019).

Synaptril's label says "Enhances Memory & Focus*", and no published trial has tested the capsule. See reading brain supplement ads.

What should you ask before buying a memory supplement?

Ask for a placebo-controlled trial of the finished product. Without one, read the memory line as a hope.

  1. Label front“Advanced Brain Support*”No trial has tested Synaptril. Structure/function wording with the FDA asterisk; it is not a claim to treat any disease. (FDA, Questions and Answers on Dietary Supplements)
  2. Label front“Enhances Memory & Focus*”Reviews of brain supplements find no proof that any of them prevents memory decline. None of the six ingredients has strong memory evidence at these amounts. (NCCIH, Supplements for Cognitive Function) (AARP / GCBH, Brain Health Supplements 2019)
  3. Label front“Boosts Mental Energy*”No caffeine or other stimulant is on the label. Researchers define mental energy as mood, motivation and sustained attention, and supplement evidence for it is inconsistent. (Tufts, Mental Energy Claims)
  4. Brand badge“Doctor Formulated”No formulator is named on the label, the order page or the badge. (FTC, Health Products Compliance Guidance)
  5. Brand badge“Registered FDA Facility”The label prints no facility statement. Registration, where it exists, is not FDA approval. (FDA, Questions and Answers on Dietary Supplements)
  6. Brand badge“100% Natural Ingredients”No certifier is named. The capsule also lists flow agents such as silicon dioxide and magnesium stearate. (NCCIH, Using Dietary Supplements Wisely)
  7. Bottle backThe FDA statement'Not intended to diagnose, treat, cure or prevent any disease.' That line is accurate, and it is the one to keep in mind. (FDA, Questions and Answers on Dietary Supplements)

Claims as printed on the label and the brand badges. A health claim needs competent and reliable scientific evidence, generally from human trials of the same product (FTC, Health Products Compliance Guidance).

Not as of our latest source. The maker appealed the December 2024 order, and the appeal was pending in February 2026. Check court news for anything newer.

No. They are separate products from separate companies. We cover the case because it shows how memory claims get tested.
